JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The petitioner is apprehending his arrest in connection with Marhowra P.S. Case No. 304/2016, registered for offence punishable under Section 419, 420, 342, 323 and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is running a Grahak Sewa Kendra and the informant has deposited some money and when the informant and others went to enquire about the same, the petitioner assaulted them and except that there is no allegation against the petitioner. Heard learned A.P.P. who has opposed the prayer for anticipatory bail of the petitioner.

Having heard the learned counsel for both side and considering the submissions and perusal of the impugned

Patna High Court Cr.Misc. No.954 of 2017 (2) dt.31-01-2017 order itself shows that some of the witnesses have not supported the occurrence, let the petitioner above named in the event of his arrest or surrender in the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., IInd, Chapra, Saran in connection with Marhowra P.S. Case No. 304/2016, subject to the conditions laid down under Section 438(2) Cr.P.C.

This is subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, and further he will co-operate in the investigation of the case and make himself available before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bond shall be liable to be cancelled and he will not take any step to tamper with the evidence of the case.
