This application has been filed for quashing of order dated 24-12-2009 passed by Sri R. K. Singh, learned Judicial Magistrate-Ist Class, Patna in Sachiwalaya P.S. Case No. 146 of 2008, G.R. No. 5340 of 2008 whereby and whereunder, the learned Magistrate took cognizance against the petitioner for the offence under Sections-420, 409 of the Indian Penal Code. After some argument, learned counsel for the petitioner seeks permission to withdraw this application with liberty to raise all the defence at the time of framing of charge. Permission is accorded.
