The petitioner seeks bail in Kurtha P.S. Case No. 167 of 2016 registered under Section 392 of the Indian Penal Code.

Four motorcycle borne criminals are said to have looted the bag of the informant containing Rs.2,60,000/-. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from his conscious physical possession. He was not put on T.I.P. There is nothing on the record to indicate the complicity of the petitioner in the occurrence barring confessional statement of the co-accused Ranjit Kumar, which has

Patna High Court Cr.Misc. No.38095 of 2017 (2) dt.10-08-2017 2/2 no evidentiary value in the eye of law. The petitioner has been languishing in custody since 19.04.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 167 of 2016.
