The petitioners seek bail in Narpatganj P.S. Case No. 61 of 2017 registered under Section 392 of the Indian Penal Code.

As per the prosecution case, 3 to 4 miscreants are said to have snatched the motorcycle and mobile of the informant and his co-villagers on the point of firearm. It has been submitted by learned counsel for the petitioners that nothing incriminating article has been recovered from their conscious physical possession. Petitioners are not named in the F.I.R. There is nothing on record indicating the complicity of the petitioners barring the confessional statement of co-accused. The petitioner has been named in some of the cases

Patna High Court Cr.Misc. No.38035 of 2017 (02) dt.10-08-2017 2/2 but in all those cases they have been on bail. The petitioners have been languishing in custody since 17.05.2017 Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No.61 of 2017.
