The petitioner seeks regular bail in Town P.S. Case No.310 of 2017 registered for the offence under Sections 25 (1-b) a, 26(ii) of the I.P.C.

Allegation against the petitioner is of recovery of one loaded pistol and live cartridge from his possession.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, He has been made accused in one another case in which he was arrested and in that case he is on bail. He is

Patna High Court Cr.Misc. No.41499 of 2017 (2) dt.07-09-2017 2/2 in custody since 17.05.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, and recovery of arms, at this stage, I am not inclined to grant bail to the petitioner. However, petitioner will be at liberty to renew his prayer for bail after completion of his six months in custody.

With the aforesaid observation, this application is disposed of.
