The report of learned trial court shows that out of eight proposed prosecution witnesses, seven have already been examined and one witness has been permitted to give up to adduce the evidence by the prosecution. The aforesaid fact goes to show that prosecution has already concluded its evidence but still the case is pending for recording the evidence. In view of the aforesaid facts and circumstances as well as submissions of the parties, the prayer for bail of the petitioner in connection with Anti P.S.case No. 43 of 2014, pending the court of 1st Additional Sessions Judge cum Special Judge ( POCSO Act) , Gaya is again rejected.
However, learned trial court should expedite the trial of
Patna High Court Cr.Misc. No.1851 of 2016 (3) dt.11-05-2016 2/2 the petitioner and try to conclude the same as early as possible, preferably, within three months from the date of receipt/ production of copy of this order.
