Two petitioners, who are in custody since 18.06.2017 in Mansi P.S. Case No. 137 of 2017 registered for the offence under section 188, 120( B) / 34 of the Indian Penal Code 1860, Section 30(A) of the Bihar Prohibition and Excise Act, 2016 have prayed for grant of bail.

It was submitted by learned counsel for the petitioners that completely in illegal manner petitioners have been detained since long on the basis confessional statement of one of the accused, who was driving the vehicle from which huge quantity of Indian make foreign liquor was recovered. Considering the fact that petitioners' name has come

Patna High Court Cr.Misc. No.39342 of 2017 (2) dt.19-08-2017 2/2 as per confessional statement of the co -accused , there is no reason to further detain the petitioners.

Let the petitioners Navin Kumar Sah , Mithu @ Sardar Harvinder Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Khagaria / concerned court in connection with Mansi P.S. Case No. 137 of 2017.
