JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Ram Sumiran Rai, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 05.08.2017 in Sheikhpura P.S. Case No.227/17 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

By way of referring to the statement made in paragraph-3 of the petition, learned counsel for the petitioner submits that the petitioner is having clean antecedent and nothing was recovered from his conscious possession, rather recovery of about 13 Liter of Indian Make Foreign Liquor was shown from near the house of the petitioner. He further submits that on the basis of disclosure made by co-accused, the petitioner was made

Considering the nature of accusation, clean antecedent as well as the fact that the petitioner's name has come only on the basis of confession, let the petitioner, namely, Guddu Tanti be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. District & Sessions Judge, Sheikhpura in connection with Sheikhpura P.S.
