This application for anticipatory bail arises out of Chakai P.S. Case No. 12 of 2019, disclosing the offence under Sections 341, 323, 448, 308/34 of the Indian Penal Code. There is allegation against the petitioner and other named accused persons of having entered into the informant's house and assaulted him.

Learned counsel appearing on behalf of the petitioner has submitted that for the occurrence said to have taken place at 12.00 on 18.01.2018, the FIR has been registered on 19.01.2019 at 7.15 p.m. for which there is no explanation in the FIR. He has submitted that other co-accused persons have been allowed anticipatory bail. He has also submitted that petitioner and

Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate, IIIrd Class, Jamui in Chakai P.S. Case No. 12 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
