=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 16-07-2018 Heard learned counsel for the petitioner and T. M. Bhagalpur University (hereinafter referred to as the 'University'). Nobody appears on behalf of the State.
2. The petitioner has moved the Court for the following
Patna High Court CWJC No.20472 of 2016 dt.16-07-2018 2/3 reliefs:
"That this application is for issuance of an appropriate writ, order or direction commanding upon the respondent authorities for fixation of pension of the petitioner for the post of Head Assistant, making payment of arrears thereof giving seniority from the year 1994 and also for making payment of Gratuity, leave in cash, LIC and Employees Welfare Fund."
3. Counter affidavit has been filed on behalf of the University in which details have been given with regard to payment made under each head with the further statement that even the promotion has been granted to the petitioner on the post of Head Assistant and accordingly, pension has been revised and fixed at a particular amount.
4. Having regard to the aforesaid, the Court finds that the admitted dues of the petitioner have been paid. However, with regard to there being any discrepancy relating to calculation or otherwise, the petitioner shall be at liberty to represent before the Registrar of the University who shall look into the matter and pass appropriate orders.
5. Learned counsel for the petitioner and the University agree to the same.
6. Having regard to the aforesaid, the writ petition stands
Patna High Court CWJC No.20472 of 2016 dt.16-07-2018 3/3 disposed off with liberty aforesaid.
7. If such representation is filed by the petitioner before the Registrar of the University within four weeks from today, the same shall be looked into and a reasoned order passed within four weeks from the date of filing such representation. If it transpires that any further amount is required to be paid to the petitioner, in terms of the order to be passed, the same shall also be done within the next four weeks.
