The petitioner apprehends his arrest in a case registered for the offence under Sections 461, 379 of the Indian Penal Code.
This petitioner alongwith co-accused Mithun Sah and 20 unknown persons allegedly committed theft of wheat packets worth Rs. 6,20,000/- and cash of Rs. 12,000/- from the godown of the informant.
It is submitted on behalf of petitioner that F.I.R. has been lodged after a delay of 7 days and there is no explanation for the same. It is further submitted that petitioner has been falsely implicated in this case.
However, learned A.P.P. for the State vehemently opposes the prayer for bail and submits that there is specific and direct allegation against this petitioner and others for committing theft in the godown of informant.
Patna High Court CR. MISC. No.72901 of 2022(3) dt.04-07-2023 2/2 Considering the same, the prayer for anticipatory bail of petitioner is rejected.
