This application is for grant of regular bail in connection with Haspura P.S.Case No. 95/2017 registered for the offences punishable under Sections 399/402 of the Indian Penal Code and Section 25 (1-B)a/ 26/35 of Arms Act. Allegation against the petitioner is of recovery of a loaded pistol and two live cartridges and further he was arrested on chase by the police.

Submission of the learned counsel for the petitioner is that a loaded country made pistol and two live cartridges have been recovered and he is in custody for 4 1⁄2 months. He is also accused in two cases but on bail.

Heard the learned A.P.P. also who opposed the prayer

Patna High Court Cr.Misc. No.49984 of 2017 (3) dt.09-11-2017 2/2 for bail stating that apart from recovery of loaded pistol he has criminal antecedent.

Having heard both sides and in view of the facts and circumstances of the case, this application is disposed of with direction to the trial court to expedite the trial and conclude it within a period of five months, and if not concluded, he will release the petitioner on bail to his own satisfacftion.
