The petitioner apprehends his arrest in a criminal prosecution registered under Sections 302, 307 and some other allied offences under the Indian Penal Code as also under Section 27 of the Arms Act.

Taking into consideration the fact that the petitioner is specifically named in the F.I.R vide Annexure-1 as an accused and he is said to be one of the assailants of the deceased and further taking into consideration the fact that even regular bail of coaccused Baban Singh @ Bahhan Singh and Lalan Singh @ Lalana has been rejected by a co- ordinate Bench of this Court by order dated 15.09.2015 passed in Cr. Misc. No. 22493 of 2015 and further taking into consideration the fact that he is accused in two more criminal cases, besides the present one, which have been mentioned in paragraph-3 of the anticipatory bail application, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Patna High Court Cr.Misc. No.518 of 2016 (3) dt.18-02-2016 2/2 anticipatory bail in connection with Parbatta P.S. Case No. 265 of 2014 dated 16.10.2014 pending in the Court of the learned Additional Chief Judicial Magistrate, Khagaria, is hereby rejected. However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered and decided on its own merit without being prejudiced by the present order.
