Petitioner seeks bail in Patori P.S. Case No. 150 of 2017 for the offence punishable under Sections 363, 366A and 34 of the Indian Penal Code.
Allegation against the petitioner is that he was also present alongwith Rahul Chaudhary for kidnapping the daughter of the informant.
It has been submitted on behalf of the petitioner that only allegation against another accused is that he had taken the victim girl on his motorcycle for preparation of Adhar Card and after preparation of Adhar Card of the victim girl, he left her to an unknown place. Petitioner was also there. There is no any other allegation against the petitioner- Rajesh Singh or Rahul Chaudhary. The Medical
Patna High Court Cr.Misc. No.49029 of 2017(2) dt.18-10-2017 2/2 Board ascertained the age of the victim girl to be sixteen and a half years to seventeen and a half years. The petitioner is in custody since, 29.05.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Patori P.S. Case No. 150 of 2017.
