JUSTICE RAJIV ROY ORAL ORDER 07-11-2022 The present petition has been filed under Order 41 Rule 11 of the CPC challenging the order dated 1.11.2018 passed by the learned Subordinate Judge-1st, Bettiah, West Champaran in P.S. No. 236 of 2017 by which the application filed by the plaintiff/defendant No. 1 under Order 39 Rule 1 and 2 of the CPC has been allowed and the petitioners herein have been directed to maintain status quo in the matter. Learned counsel for the appellant, at the outset submits that he will be contended if the matter is disposed of with a direction for an early disposal of the PS No. 236 of 2017. Learned counsel for the respondents No. 1 fairly submits that he has no objection if the matter is disposed of within a time frame.

Accordingly, the present M.A. No. 1044 of 2018 is disposed of with a direction to the Court of learned Subordinate

Patna High Court MA No.1044 of 2018(14) dt.07-11-2022 2/2 Judge-1st, Bettiah, West Champaran to take up the matter and dispose of the same preferably within a period of one year. The aforesaid M.A. No. 1044 of 2018 stands disposed of.
