JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-09-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 406, 323, 341, 354(B), 384, 386, 452 and 504/34 of the Indian Penal Code.

It is a case of misappropriation of the amount of government money.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that petitioners have been made accused in this case only for the reason that petitioner no.1 is the ward member of ward no.3, Gram Panchayat Sirisiya while the petitioner no.2

Patna High Court CR. MISC. No.71575 of 2021(4) dt.27-09-2022 2/2 is her husband, who has no any role in transaction of any amount while the petitioner no.3 is Ward Secretary of ward no.03 Panchayat Sirisiya. He further submits that there is neither any specific allegation of any overt-act against these petitioners nor anyone has filed any complaint nor the case filed by the petitioner no.1 has been found untrue. Petitioners have clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, District-West Champaran in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 255 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
