2. The petitioner is seeking regular bail in connection with Khagaria (Muffasil) P.S. Case No. 811 of 2023 for the offences punishable under Sections 341, 323, 325, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, allegation against the petitioner is that he opened fire upon the son of the informant but did not hit him. It is further alleged that co-accused assaulted the informant's son by means of iron rod due to which his hand got fractured.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.66778 of 2024(2) dt.26-09-2024 2/2 this case due to land dispute. He has further submitted that all the cases which have been mentioned in para-3 of the bail petition, have been lodged by the informant's side. The petitioner is under custody since 14.03.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances of the case as well as period of incarceration of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 811 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
