The petitioner apprehends his arrest in Paliganj P.S. Case No. 167 of 2016 instituted for the offence under Section 47 of Bihar Excise (Amendment) Act.
It has been stated in the written report that total 335 bottles of illegal liquor has been recovered from the house of Budhan Chaudhary. Police prepared the seizure list. Budhan Chaudhary disclosed the name of this petitioner. The seizure list is enclosed with the First Information Report, which bears the signature of Budhan Chaudhary.
From the written report itself, it is clear that the alleged liquor has been recovered from possession of Budhan
Patna High Court Cr.Misc. No.52 of 2017 (3) dt.04-02-2017 2/2 Chaudhary. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Paliganj P.S. Case No. 167 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
