Although the petitioner has challenged the order of his transfer dated 8.10.2018, but with the passage of time certain developments have taken place and as such, learned counsel for the petitioner submits that the petitioner would be satisfied if the writ petition is disposed of with direction to the respondents to take appropriate decision with regard to payment of salary for

Patna High Court CWJC No.24289 of 2018(2) dt.11-06-2020 2/2 the period the petitioner has not been paid salary and his case for voluntary retirement may be considered in accordance with the law.

Considering the aforesaid, the writ petition is disposed of with liberty to the petitioner to file fresh representation before the General Manager-cum-Disciplinary Authority, Madhya Bihar Gramin Bank, Head Office,Sri Bishnu Commercial Complex, New Py-pass NH 30, Ashochak, Patna 800016. It is made clear that this Court has not expressed any opinion on the claim of the petitioner. It shall be open to the respondents to pass reasoned and speaking order on the representation with regard to the claim of the petitioner for payment of salary and also for voluntary retirement in accordance with law within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
