JUSTICE PARTHA SARTHY ORAL ORDER 27-02-2020 Heard learned counsel for the petitioner, learned counsel for the O.P. No.2 and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Narhat P.S. Case No.140 of 2017 registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.

By order dated 18.12.2019, the matter was referred to the Patna High Court Mediation Centre, where both the parties appeared. As has been informed by the learned counsel for the parties, together with the report of the Mediator dated 05.02.2020, the parties have arrived at an agreement executed at the Patna High Court Mediation Centre on 03.02.2020, which has been enclosed with the report of the Mediator. As per the

Patna High Court CR. MISC. No.59300 of 2019(7) dt.27-02-2020 2/2 agreement, the first party i.e. Deepak Kumar @ Deepu Kumar @ Deepu has agreed to pay a sum of Rs. 2,50,000/- by five cheques of equal installment i.e. Rs. 50,000/- each. It is submitted by learned counsel for the O.P. No.2 that the first cheque has been honoured.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender in connection with Narhat P.S. Case No.140 of 2017, he will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Nawada, subject to the condition as laid down under section 438(2) of the Criminal Procedure Code.

It may be added here that the grant of bail would be subject to both the parties abiding by the terms of the agreement arrived at, as mentioned above.
