This is the second attempt by the petitioner for grant of anticipatory bail in connection with Bettiah Town P.S. Case no. 358 of 2020 instituted for the offence punishable under Sections 420, 406 and 34 of the Indian Penal Code. Earlier his application for anticipatory bail was rejected by this Court vide order dated 30.11.2021 (Annexure-1) passed in Cr. Misc. No. 2214 of 2021, with an observation that if the petitioner surrenders before learned Court below within a period of six weeks from today and prays for regular bail, his prayer for bail shall be considered without being prejudiced by

It is submitted by learned counsel for the petitioner that up till now petitioner has withdrawn only Rs. 2 lakh from the account mentioned in the FIR. The petitioner is renewing his prayer for anticipatory bail on the ground that he has not withdrawn any further amount from the said account and he is also ready to deposit Rs. two lac, which he has withdrawn from the account, before the learned Court below.

Considering the fact that the petitioner has neither surrendered before the learned Lower Court nor any further development has occurred in the present case, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
