This is an application for bail in connection with Ratanpura P.S. Case No. 20 of 2017 registered for the offences punishable under Sections 38(a) and 41(A)(2) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 505 litres of liquor from the boat and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that he was not arrested at the spot and his name has been disclosed by co-accused to the police. So far other case is concerned, it is submitted that though he is made accused in other case but the same is not of similar nature and further he is in custody since 23.8.2017.

Having heard both sides and in view of the recovery of huge quantity of liquor, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of three months by conducting trial on day to day basis. If trial is not concluded within the said period, trial court will release the petitioner on bail to its own satisfaction on the condition that he will co-operate in disposal of trial.

With the above observation, this application is disposed of.
