Petitioner seeks bail in Konch P.S. Case No. 186 of 2017 for the offence punishable under Section 7 of the Essential Commodities Act, 1955.

Allegation against the petitioner is that he was driving the tractor upon which wheat allotted to PDS Shop dealer Sachchidanand Kumar was kept, which was likely to be sold in black market.

It has been submitted on behalf of the petitioner that the petitioner is the driver of PDS dealer. He has no concern with the wheat and he was only driving the Tractor. It has further been submitted that the petitioner has got no criminal antecedent and is in custody since, 09.08.2017.

No.49118 of 2017(2) dt.18-10-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st, Additional Sessions Judge, Gaya in connection with Koonch P.S. Case No. 186 of 2017.
