The petitioner is accused in connection with Sessions Trial No. 231 of 2019 arising out of Maner P.S. Case No. 425 of 2018, registered under Section 498(A), 304B and 201/34 of the Indian Penal Code, pending in the court of Additional Sessions Judge-VI, Danapur, Patna. The accusation is of killing of daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry within two years of marriage and to dispose of her dead body.
Learned counsel for the petitioner submits that petitioner is the husband of the deceased, daughter of the
Patna High Court CR. MISC. No.56691 of 2019(3) dt.04-12-2019 2/2 informant and he is in custody since 24.08.2018. Further submission is that, in fact, deceased, daughter of the informant become ill due to suffering from stomach pain and she was rushed to the hospital but she died and thereafter, information was given to the family of the informant and the family of the informant participated in the funeral but with ulterior motive the present case has been lodged with false allegation. Admittedly, deceased, daughter of the informant, was died within two years of her marriage at her Sasural. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
