The matter has been taken up through video conferencing.

Prayer for bail of this petitioner was earlier rejected by this court vide order 08.04.2021 passed in Cr. Misc. No. 4976 of 2021.

By order dated 05.01.2022 a report about the stage of trial has been called for from the court below and from perusal of report it appears that out of eight witnesses two witnesses have already been examined.

Considering the quantity of recovery, nature of accusation, gravity of the offence and progress of the trial, I am

Patna High Court CR. MISC. No.71691 of 2021(3) dt.16-02-2022 2/2 not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, since the petitioner is in custody since 23.05.2018, the trial court is directed to conclude the trial as early as possible.
