The petitioner is languishing in custody since 05.03.2014 in a case registered for the offences punishable under Sections 394, 307 of the Indian Penal Code and 25(1-B)A, 26 and 35 of the Arms Act.

Four persons robbed cash of about Rs.6,99,100/- on pistol point. Two of them were apprehended on chase. The petitioner was one of them. Nothing was recovered from the possession of the petitioner. Though, from other apprehended co-accused Sanjiv @ Sandip Kumar two live cartridges were recovered. It appears subsequently on the confession of Ravi Shankar Sah and Baba two pistols and four

Patna High Court Cr.Misc. No.23538 of 2014 (07) dt.05-01-2015 2/2 cartridges were recovered.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the petitioner was apprehending from the place of occurrence, but neither any arms nor alleged money were recovered, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, District - Patna in connection with Agamkuan P.S. Case No. 68 of 2014.
