The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 15.05.2017 passed in Cr. Misc. No. 18732 of 2017, on the ground that the petitioner is in custody since 20.11.2016, during investigation the story of demanding ransom has not been found true and post mortem report does not support the prosecution version and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of bail by submitting that the petitioner has dashed the motorcycle by truck causing death of Anil Kumar and motorcycle was also badly damaged as he was trying to stop the truck when the petitioner was fleeing away with the truck.
In the facts and circumstances stated above, finding no
Patna High Court Cr.Misc. No.50853 of 2017(2) dt.18-10-2017 2/2 good ground for reconsideration of the prayer of bail of the petitioner, again his such prayer stands rejected in connection with Bihta P. S. Case No. 324 of 2015 pending in the court of A.C.J.M., Danapur.
However, learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order after taking the same on priority basis. (Jitendra Mohan Sharma, J) avin/- U T
