The petitioners seek regular bail in connection with Piprakothi PS Case No. 203 of 2016 registered for the offences punishable under Sections 304B, 201 and 34 of Indian Penal Code.
It has been alleged in the fardbeyan that all the accused persons have conspired to kill the victim girl for want of dowry. It is further alleged that regular demand for motorcycle was being made and on account of non-fulfillment of the same, the accused persons had done away with the girl.

No.49994 of 2017 (2) dt.18-10-2017 2/3 The learned counsel for the petitioners submits that as far as the petitioner nos. 1 and 2 are concerned, they are the brother of father-in-law of the victim girl while the petitioner no. 3 is cousin brother of the husband of the victim girl. It is further submitted that all these three petitioners do not have any involvement with the alleged offence and they also live separately from the family of father-in-law / husband of the victim girl. It is also submitted that the husband is in custody, hence no prejudice would be caused if these three petitioners are released on bail especially on account of the fact that they are distant relative.
In the facts and circumstances of the present case, the petitioners, namely (1) Sunar Sahani @ Ram Sunar Sahani; (2) Dasai Sahani; and (3) Sanjay Sahani are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi PS Case No. 203 of 2016.
It is further directed that all the three petitioners would mark their attendance before the Officer In-Charge of the concerned Police Station on every Monday of the week at 10:00 A.M. and in case of two consecutive defaults in marking
Patna High Court Cr.Misc. No.49994 of 2017 (2) dt.18-10-2017 3/3 attendance before the Officer In-Charge concerned would lead automatic withdrawal of the privilege of bail granted by this order and the petitioners would be liable to be taken into custody forthwith.
