2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 307, 325, 504 of the Indian Penal Code and section 30(a) and 45 of the Bihar Prohibition and Excise Act.

3. 50 litres of illicit liquor has been recovered from a sack which was allegedly thrown by petitioner other co-accused persons.

4. It is submitted by the counsel for petitioner that no incriminating article has been recovered from conscious possession of this petitioner or from the house of this petitioner. Petitioner has falsely been implicated in this case merely on

Patna High Court CR. MISC. No.64955 of 2023(2) dt.17-10-2023 2/2 suspicion. Petitioner claims clean antecedent.

5. Considering the facts aforesaid and clean antecedent, the petitioner above-named in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise, Bettiah, West Champaran in connection with Sikarpur P.S. Case No. 623 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
