JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the complainant and is languishing in jail custody since 28-09-2015 in a case in which, cognizance has been taken for the offence punishable under Section-498A of the Indian Penal Code and Section-4 of Dowry Prohibition Act.

Submission on behalf of the petitioner is that petitioner is still ready to keep the complainant but it is the complainant who does not want to lead her conjugal life with the petitioner. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 873C of 2012 to the satisfaction of

Patna High Court Cr.Misc. No.57586 of 2015 (2) dt.22-12-2015 2/2 learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran.
