2. The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi P.S. Case No. 970 of 2022 dated 03.12.2022 registered for the offences punishable under Sections 406, 420 and 379 of the Indian Penal Code.

3. As per the prosecution case, the informant had given his trucks to the petitioner and the co-accused persons on rent at the monthly rate of Rs. One Lakh Eighty Thousand. Thereafter, the co-accused Anupam Kumar Sahu paid Rs. 3,80,000/- in his account and for the remaining amount he was

Patna High Court CR. MISC. No.59792 of 2025(2) dt.03-09-2025 2/3 in continuous telephonic contact, but they failed to make the payment and claimed that both trucks has been stolen. Thereafter, the informant tried to track his truck but could not located them. Accordingly, the FIR has been lodged against the accused persons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner is the registered owner of Krishna Transport and an agreement was also done between the petitioner and Nagendra Kumar Sinha and the truck of the petitioner was also stolen. The petitioner has no concern with the alleged occurrence. As per the impugned order dated 23.01.2025, the petitioner has 75 criminal antecedents in which 62 criminal cases have been lodged against the petitioner in the year 2022 and 13 criminal cases have been lodged in the year 2023. The petitioner is in custody since 02.09.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the petitioner is a member of international gang involved in taking truck by doing fraud and selling the same for his benefits.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Sitamarhi P.S. Case No. 970 of 2022, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
