The petitioner seeks bail in Jadia P.S. Case No.104 of 2017 registered under Section 25 (1-b)A, 26 and 35 of the Arms Act.

As per the prosecution case, one live cartridge is said to have been recovered from the possession of the petitioner by patrolling party.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner has no criminal antecedent. The petitioner has been languishing in custody since 09.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond

Patna High Court Cr.Misc. No.50496 of 2017 (02) dt.18-10-2017 2/ 2 of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Supaul in connection with Jadia P.S. Case No.104 of 2017.
