The petitioner apprehends his arrest in Narpatganj P.S. Case No.186 of 2019, registered under Sections 341, 323, 354(B), 379, 427, 504 and 34 of the Indian Penal Code. The informant named the petitioner along with 12 other accused persons and made allegation of assault. The allegation against the petitioner is that the petitioner took out Rs.2200/- from the pocket of the informant.

The learned counsel for the petitioner submits that there is a counter version being Narpatganj P.S. Case No.185 of 2019. No specific allegation of assault is made against the petitioner. There appears that both the sides engaged in mutual assault on each other on account of land dispute. Taking into consideration the facts and nature of

No.57022 of 2019(2) dt.16-09-2019 2/2 allegation made against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No.186 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
