The sole petitioner, who is only a witness on a registered sale deed, has approached this Court for grant of anticipatory bail in Sahajitpur P.S. Case No.21 of 2016 registered for the offence under Sections 363, 420, 467, 471 and 34 of the Indian Penal Code.

It was submitted by learned counsel for the petitioner that father of the informant, who was title-holder of the land , had transferred some land to the vender through registered sale deed and the petitioner stood as witness only. He also referred to the F.I.R., which was lodged on the basis of complaint case i.e.

Patna High Court Cr.Misc. No.55054 of 2016 (2) dt.22-12-2016 2/2 Complaint Case No.329/2016, which was subsequently referred to the police for its registration and investigation under Section 156(3) of the Code of Criminal Procedure.

Considering the nature of accusation, there is no reason to deny the prayer for grant of anticipatory bail to the petitioner. Accordingly, let the petitioner, namely, Shankar Mahto, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Divya Shekhar, J.M. Saran, Chapra in connection with Sahajitpur P.S. Case No.21/2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
