Petitioner is languishing in custody since 16.07.2017 in connection with Sasaram Town P.S. Case No. 760/2017 for offences punishable under Section 366-A of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his 13 year old daughter went for a morning walk but did not return. It is alleged that the petitioner had kidnapped his minor daughter.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent, no
Patna High Court Cr.Misc. No.47911 of 2017 (4) dt.18-12-2017 2/2 overt act has been alleged against him and was not named in the confessional statement of the victim girl. He submits that there was a tussle between the mother and the victim girl and the victim girl had gone to her grandmother's place.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram (Rohtas) in connection with Sasaram Town P.S. Case No. 760/2017.
