JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act and section 272 and other sections of the IPC. As per the prosecution case, 1620 liters of spirit was recovered from three vehicles.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Raushan Kumar who was apprehended on the spot. He stated that the said consignment had come at the instance of the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way concerned with the

Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act Muzaffarpur in Ahiyapur Police Station Case No. 990/2020.
