The petitioner seeks bail in connection with S.Tr. No. 178/2017, arising out of Sono (Charka Patthar) P.S. Case No. 27/2017 dated 16.02.2017 instituted for the offences under Sections 147, 148, 149, 120(B), 121(A) of the Indian Penal Code, Sections 25(1-B)A, 26 of the Arms Act and Sections 16, 17, 18, 19, 20, 21 and 22 of Unlawful Activities (Prevention) Act, 1967. The petitioner is said to have been arrested with a bag containing one country made pistol, two live cartridges and pamphlets in support of Naxal movement.

Learned counsel for the petitioner has submitted that he was not arrested at the place from where he has been shown to have been arrested; rather he has been arrested from his residence

Patna High Court Cr.Misc. No.47819 of 2017 (3) dt.02-01-2018 2/2 and has falsely been implicated in the present case. The petitioner is in custody since 17.02.2017. Prior to the involvement of the petitioner in the present case, he was made accused in another case, in which he is on bail. Considering the period of custody of the petitioner, this Court is inclined to grant bail to him.

The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd, Jamui in connection with S. Tr. No. 178/2017, arising out of Sono (Charka Patthar) P.S. Case No. 27/2017. (Ashutosh Kumar, J.) Rakhi U T
