JUSTICE SHIVAJI PANDEY ORAL ORDER 16-07-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceeding. In this case, the petitioner is seeking anticipatory bail in connection with Govindganj P.S. Case No. 53 of 2018, G.R. No.1413 of 2018, registered for the offence under Sections 341, 323, 324, 307, 337, 338, 504 and 354/34 of the Indian Penal Code.

Allegation has been made that all the accused persons including this petitioner assaulted the family members of the informant with deadly weapons, in which two injured namely Kameshwar Tiwari and Nikesh were referred to Patna Medical College and Hospital, Patna from Sadar Hospital, Motihari.

Patna High Court CR. MISC. No. 73819 of 2019(4) dt.16-07-2020 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within ten weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
