JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 11-10-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in Triveniganj P.S. Case No. 197 of 2017 registered under Sections 420, 467, 468 and 379/34 of the Indian Penal Code.

Petitioners along with other accused persons claiming themselves as ornament cleaner grabbed the ornaments of the wife of the informant on the pretext of cleaning the same free of cost. They were apprehended after giving chase while two other accused persons managed to escape.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the

Patna High Court Cr.Misc. No.48069 of 2017 (2) dt.11-10-2017 2/2 conscious physical possession of the petitioners. They have been falsely implicated in the case mere on suspicion. They have been languishing in custody since 18.06.2017. Earlier bail prayer of the petitioners was rejected by this court vide order dated 11.08.2017 passed in Cr. Misc. No. 38156 of 2017 with liberty to renew the same after framing of charge or after four months whichever happens earlier and now the charge has been framed against the petitioners on 24.08.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Supaul in connection with Triveniganj P.S. Case No. 197 of 2017.
