The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 153, 153A, 341, 323, 324, 325, 307, 353, 332, 333, 337, 338, 427, 151, 152, 153, 187, 188, 189, 120B, 295, 295A and 358 of the Indian Penal Code read with Sections 269, 270 and 271 of the Epidemic Disease Act-3 of 1897.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the aforesaid F.I.R. was instituted against 56 named accused persons and 250 unknown.

Learned counsel for the petitioner submits that 26

Patna High Court CR. MISC. No.71765 of 2021(2) dt.11-05-2022 2/2 accused persons have been granted anticipatory bail vide order dated 22.11.2021 passed in Cr. Misc. No. 13658 of 2021. It is submitted that the petitioner is similarly situated like those 26 accused persons.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Majhauliya P.S. Case No. 426 of 2020.
