The petitioner seeks bail in connection with Maner P.S. Case No. 351 of 2021 instituted for the offences under Sections 30(a), 36 and 41(i) (ii) of the Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 1534.050 litres of liquor out of which 1372.050 litres of liquor was recovered from a truck. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came in the confessional statement of accused who was apprehended.

Considering the fact that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case, he was not arrested from the spot and his name came in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Maner P.S.
