The petitioners have renewed their prayer for prearrest bail in connection with Khirhar P.S.Case No. 34 of 2013 registered under Section 302/201 of the Indian Penal Code. Earlier the application of the petitioners for grant of pre-arrest bail was rejected by this Court on merits by a reasoned order dated 14.10.2015 passed in Cr.Misc. No. 44619 of 2015. It would be evident that instead of appearing before the court and praying for bail, the petitioners are evading arrest. From the previous order, it would be evident that in course of investigation several witnesses examined under Section 161(3) of the Code of Criminal Procedure had taken the name of the petitioners as the

Patna High Court Cr.Misc. No.3087 of 2016 (4) dt.06-04-2016 2/2 miscreants being involved in the crime.

In that view of the matter, I see no reason to take a different view in the matter. Accordingly, the application is dismissed.
