The petitioner seeks bail in K. Hat P.S. Case No.438 of 2017 registered under Section 379 and 411 of the Indian Penal Code.

As per the prosecution case, the motorcycle of the informant has been stolen by some unknown miscreants. The petitioner was apprehended with the aforesaid motorcycle and the liquor regarding which Baisi P.S. Case No.129/17 was lodged and the petitioner has been remanded in this case from the said case. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. As a matter of fact, the petitioner in his confessional statement has rightly stated that he has purchased the aforesaid motorcycle from

Patna High Court Cr.Misc. No.50384 of 2017 (02) dt.18-10-2017 2/ 2 one Pintu Singh in Rs.10,000/- and he has no knowledge that the said motorcycle is stolen one. The petitioner has been languishing in custody since 19.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No.438 of 2017.
