====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-11-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner is apprehending her arrest in connection with Bhore P.S. Case No. 46 of 2024 dated 21.02.2024 registered for the offences punishable under Section 304B read with Section 34 of the I.P.C.

3. As per the prosecution case, the petitioner and the coaccused persons are alleged to have strangulated the informant's daughter to death due to non-fulfilment of demand of Motorcycle and Golden chain as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner is the mother-in-

Patna High Court CR. MISC. No.64775 of 2024(2) dt.20-11-2024 2/3 law of the deceased. The petitioner neither demanded any dowry nor tortured the deceased. The father-in-law of the deceased, Nand Kishore Singh has given an information with regard to self suicide of the deceased to the concerned police station. The petitioner is separate in mess and property from the husband of the deceased. She has no concern with the alleged offence. The petitioner is a lady aged about 60 years old. It is further submitted that the other co-accused person Nand Kishore Singh who is the father-in-law of the deceased has been granted regular bail by a Bench of this Court vide Cr. Misc. No. 60838 of 2024 under order dated 09.09.2024. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of her arrest/surrender before the learned court below within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gopalganj, in connection with Bhore P.S. Case No. 46 of 2024, subject to the condition as laid down
