JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Rajan, learned counsel for the petitioner and Mr. Md. Fahimuddin, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Kalyanpur P.S. Case No. 110 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a)(b)(c)(d) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender on two grounds. Firstly, on the ground of parity that one of the co-accused namely Prince Kumar Singh has already been extended the privilege of anticipatory bail by order dated 21-09-2017 passed in Cr. Misc. No. 44551 of 2017 and secondly, petitioner's name has come on the basis of confession of co-accused and petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the
Patna High Court Cr.Misc. No.48860 of 2017(2) dt.17-10-2017 2/2 petition.
Considering the fact that co-accused has been granted same privilege as well as petitioner is having clean antecedent and his name has come on the basis of confession, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Chhotan Singh @ Ravi Shankar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari in connection with Kalyanpur P.S. Case No. 110 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) anay U T
