The plea of the petitioner that the bank draft which has been referred in the written report has been given to him by Manoj during course of business transaction as petitioner happens to be a business man is a plea to be taken up during course of trial at the end of petitioner as it happens to be defence whereupon the order of cognizance could not be interfered with. Accordingly, instant petition lacks merit and is rejected.
