====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-11-2017 Heard the counsels for the parties.

The petitioner seeks bail in connection with Khusrupur P.S. Case No. 49 of 2002(Sessions Trial No. 218 of 2003) dated 11.07.2002 instituted for the offences under Sections 353, 307, 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of the Explosive Substances Act. Subsequently Section 25(1-b) a, 26, 35 of the Arms Act was also added. The petitioner was granted bail in connection with Sessions Trial No. 218 of 2003 on 30.04.2004. However, because of negligence of the Pairvikar of the petitioner, he could not appear before the Trial Court on 22.01.2016. As a result of this, the bail bond of the petitioner was cancelled. The petitioner is now in custody since

Taking into account period of custody of the petitioner, this Court is inclined to grant bail to him. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional District Judge, VII, Patna City, Patna in connection with Khusrupur P.S. Case No. 49 of 2002, Sessions Trial No. 218 of 2003.

It is, however, made clear that the petitioner should participate in the trial and his unauthorized absence on three consecutive occasions, would entitle the State to proceed for the cancellation of his bail.
