2. The petitioner has preferred this application for grant of regular bail in connection with Charpokhri PS Case No. 193 of 2022 dated 10.10.2022 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

3. Three unknown miscreants boarded on a motorcycle are alleged to have snatched the bag of the informant containing ornaments and they also fired on him.

4. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. The petitioner has no concern with the alleged occurrence. Nothing incriminating material has been recovered from the conscious physical possession of the petitioner. The name of the petitioner has transpired on the confessional statement of the co-accused

Patna High Court CR. MISC. No.63142 of 2023(2) dt.06-10-2023 2/2 Nepali @ Vikash Kumar, who has already been granted bail by a co-ordinate Bench of this Court vide order dated 17.04.2023 passed in Cr. Misc. No. 8694 of 2023. The petitioner is in custody since 26.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Charpokhri PS Case No. 193 of 2022.

7. The application stands allowed.
