2. Permission is granted.

3. Accordingly, the application is dismissed as withdrawn with respect to petitioner No.4 Dablu Kumar.

4. Heard learned counsel for the petitioner Nos. 1, 2 and 3 and learned APP for the State.

5. The petitioner Nos. 1, 2 and 3 apprehend their arrest in a case registered for the offence punishable under

Patna High Court CR. MISC. No.66707 of 2024(4) dt.16-01-2025 2/3 Sections 448, 323, 308, 379, 435, 427, 504, 34 & 341 of the Indian Penal Code.

6. As per prosecution case, on the alleged date of occurrence, the petitioners along with co-accused persons entered in the house of informant and co-accused Dablu Kumar assaulted upon the head of the informant's husband by means of iron rod and thereafter other accused persons also assaulted him.

7. Learned counsel for the petitioners submits that as per F.I.R., specific accusation of assault on the head of the informant's husband is against co-accused Dablu KUmar. So far as, these petitioners are concerned, there is no allegation of any overt act against them. Injuries allegedly caused by these petitioners are found to be simple in nature. Petitioners claim clean antecedent.

8. Learned APP for the State has vehemently opposed the bail application.

9. Considering the fact that there is no allegation of any overt act against these petitioners, clean antecedents of the petitioners and other circumstances, this anticipatory bail is allowed and it is ordered that let the above named petitioner Nos. 1, 2 and 3 in the event of their arrest/surrender before the court below within a period of eight weeks from today, be

S. Case No. 42 of 2024, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure .
