JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 08-09-2017 Heard Mr. Rana Ishwar Chandra learned counsel for the petitioner and Mr. Bipin Kumar, A.C. to S.C.3 for the State. The petitioner while praying for appropriate direction to the District Magistrate- cum- Chairman, Selection Committee, Saharsa for making payment of her honorarium for the period January, 2016 until August, 2016 as Training and Rehabilitation Officer, for the Short Stay Homes run under the State, has also prayed for appropriate direction for extension of her engagement.
Mr. Chandra learned counsel for the petitioner has referred to
Patna High Court CWJC No.94 of 2017 dt.08-09-2017 2/3 the appointment order issued by the District Magistrate-cumChairman of the Selection Committee, Saharsa bearing Memo No. 121/I.C.D.S. dated 3.1.2015 to submit that the name of the petitioner appears at Serial No.1 and she was appointed as the Training and Rehabilitation Officer for the Short Stay Home run under the supervision of the Women Development Corporation. It is submitted that though the engagement was for a year ending in January, 2016 but in between the District Programme Officer vide order bearing Memo No. 738-1 dated 24.6.2015 sent the petitioner on deputation to the Training Centre at Patna.
It is submitted that until January there was no problem but since after January 2016 although the work was being taken from the petitioner but no honorarium was being paid to the petitioner and some others and for which they represented before the District Magistrate, Saharsa vide representation dated 3.8.2016 and 29.8.2016 vide Annexure-4 and 5 respectively but the same has remained pending. He invites the attention of this Court to the advertisement dated 24.11.2016 at Annexure-7 to submit that a fresh advertisement has been issued inviting application from Non Governmental Organizations for running these Short Stay Homes, however, the process has not been completed.
In the nature of the grievance raised herein, I deem it proper to dispose of the writ petition with the direction to the District
Patna High Court CWJC No.94 of 2017 dt.08-09-2017 3/3 Magistrate, Saharsa to consider the grievance of the petitioner for payment of her dues as well as for extension of her engagement as found in the representation present at Annexure-4 and 5 and dispose of the same in accordance with law within a period of three months from the date of receipt/ production of a copy of this order.
